Whistleblowing or new legal regulation on the protection of whistleblowers (notifiers of offenses) (No. 1035)

Currently, there is a draft law on whistleblower protection (on whistleblowing) in the Chamber of Deputies, which specifies the EU directive and should be adopted by December 17, 2021 at the latest (if not adopted by this time, the EU directive will apply directly).

The act primarily regulates the system of reporting unlawful acts and its protection within employers, public contracting authorities, state administration, etc., and at the same time, it imposes certain obligations on these entities to ensure this system. As far as employers in the private sector are concerned, according to the current proposal, the obligations will only apply if they employ at least 25 employees or do their business in a certain business field (investment companies, insurance companies etc.).

The main responsibilities will include, in particular, the introduction of an internal reporting system, to be carried out by March 31, 2022 at the latest, and the appointment of a competent person to provide notification processing. For breaches of certain obligations under the law, liable persons will face penalties of up to CZK 1,000,000 or 5% of net turnover for the last completed accounting period.
